Use without written permission = trademark infringement.

Your Uploaded Content

You own your uploads — but grant us a perpetual license to:

• Process for AI functionality
• Improve accuracy (anonymized)
• Display aggregated results

You confirm: no third-party IP violation.

Prohibited Actions

• Copy or redistribute for commercial use
• Claim AI outputs as your research
• Remove copyright notices
• Integrate into other apps without consent

Violation → immediate termination + legal action

Third-Party Tech

Google Firebase, Vertex AI = licensed under their terms. We comply fully.

Enforcement

We will:

• Issue cease-and-desist
• Terminate accounts
• Pursue damages

You are liable for all losses from infringement.

7.1 Data Handling Principles

• Minimal Data Collection: Only essential data required for AI processing and accurate medicine identification is collected.
• Purpose Limitation: Data is used solely to provide, improve, and personalize the Pill Pal experience.
• No Long-Term Storage: Uploaded images or text are processed in real time and then securely deleted unless explicitly saved by the user (e.g., in “History” or “Saved Results”).
• User Control: You retain full rights to request access, correction, or deletion of your data in accordance with our Privacy Policy.

7.2 Temporary Image and Data Processing

Nebliu Digiminds does not store or maintain electronic health records, prescriptions, or medical histories. All AI-generated responses are transient, meaning they exist only during the active user session or until the user manually saves them.

7.4 Anonymization and Research Data

Certain non-identifiable, anonymized usage data may be collected to improve AI model performance, system accuracy, and service reliability. This may include generic metrics (app usage frequency, interaction time), and AI performance logs (misidentifications, low confidence results). Data is aggregated and de-identified.

8.1 Continuous Improvement

• Improve medicine recognition accuracy and speed.
• Enhance user interface and experience.
• Strengthen data protection and compliance with emerging privacy laws.
• Introduce new languages, regional drug data, and health insights.
• Optimize compatibility with updated Android, iOS, and web standards.

These updates may occur automatically without prior user notification, depending on your device settings or app version.

8.2 Scheduled Maintenance

Nebliu Digiminds may occasionally perform scheduled maintenance to update AI models, backend systems, or infrastructure hosted on Google Cloud and Firebase. Temporary unavailability or reduced functionality may occur. Users will be notified in advance (where feasible) via in-app notices, email, or the official website. Maintenance activities are typically scheduled during low-traffic periods to minimize disruption.

8.3 Service Modifications

Nebliu Digiminds reserves the right to add, modify, or discontinue specific features or functionalities, change AI model architectures and underlying datasets, adjust app pricing models, or restrict/prioritize access to certain features based on account type, region, or compliance requirements. Substantial modifications that affect user experience or data handling will be communicated via update logs, release notes, or email notifications.

8.4 Downtime and Force Majeure

While we strive for maximum uptime, Pill Pal may occasionally experience interruptions caused by network or server issues, power outages, natural disasters, government regulations, or third-party API downtimes (e.g., Google Vertex AI or Firebase). Nebliu Digiminds shall not be held liable for temporary service interruptions resulting from such events but will work promptly to restore access.

8.5 User Responsibility During Updates

• Keep the app updated to the latest version to ensure security and full functionality.
• Review any updated Terms of Service or Privacy Policy after major feature releases.
• Clear cache or restart the app if functionality changes significantly after an update.

Continued use of Pill Pal after updates or modifications constitutes acceptance of the latest Terms of Service.

8.6 Discontinuation of Service

In rare circumstances (e.g., regulatory restrictions, security risks, or business transitions), Nebliu Digiminds may temporarily or permanently discontinue the Pill Pal service. Reasonable notice will be provided where legally and technically possible, users will be given options to download or delete any saved data, and any premium users (if applicable) will receive prorated refunds according to policy.

9.1 Premium Features

The free version of Pill Pal includes basic medicine identification and educational information. Premium features may include:

• Unlimited AI scans or higher-resolution image analysis.
• Access to multilingual and offline AI processing.
• Smart Health Suggestions & Medicine Interaction Checker.
• Voice Assistant and AR (Augmented Reality) scanning mode.
• Cloud-based storage for “Saved Medicine History.”
• Ad-free experience and early access to new updates.

Premium access is optional but may significantly enhance user experience and functionality.

9.2 Payment Terms

• Payments must be made through official app stores or web platforms.
• Fees are charged in advance and are non-refundable once the period starts (except as required by law).
• Subscription fees, taxes, and charges are clearly displayed prior to confirmation.
• Pricing is based on plan duration (monthly, quarterly, annual).
• Users must ensure valid payment methods to avoid suspension.

Nebliu Digiminds reserves the right to modify pricing, introduce new plans, or discontinue old ones. Notifications will be sent in advance via email or in-app alerts.

9.3 Subscription Renewal

Subscriptions renew automatically unless canceled at least 24 hours before renewal. Fees are charged to the same payment method. Manage or cancel anytime via Google Play / App Store settings. Failed renewals may temporarily suspend premium access.

9.4 Refunds and Cancellations

Refunds are handled by your payment provider (Google, Apple, etc.). Nebliu Digiminds assists in resolving issues if requested. Refunds may be approved for duplicate payments, unauthorized transactions (within 7 days), or app failure preventing access to paid features.

9.5 Free Trials

Nebliu Digiminds may offer free or discounted trial periods. After the trial, standard subscription rates apply unless canceled. Only one trial per user account or device is permitted.

9.6 Non-Payment and Account Suspension

• Immediate downgrade to a free plan.
• Temporary suspension of premium features (e.g., cloud storage).
• Permanent loss of premium data after 90 days of inactivity.

Users can reactivate accounts anytime by resubscribing to a plan.

9.7 Taxes and Local Regulations

All payments include applicable taxes, duties, or fees as mandated by local law. Users must comply with local tax obligations for app purchases or subscriptions.

9.8 Payment Security

• All transactions processed via secure, encrypted (PCI DSS compliant) gateways.
• No credit/debit card information stored by Nebliu Digiminds directly.
• Firebase and Google Cloud handle secure token verification.

9.9 Changes to Pricing or Plans

Nebliu Digiminds may modify pricing, features, or available plans. Users will be notified at least 14 days in advance. Continued use after changes constitutes acceptance. You may cancel before renewal if you disagree with updated terms.

10.1 Informational Purpose Only

Pill Pal provides AI-powered identification and general information about medicines, ingredients, and common medical uses. It does not provide professional medical advice, diagnosis, prescription, or treatment.

Users must consult a qualified healthcare provider before making any decision regarding medicine use, dosage, or discontinuation. Nebliu Digiminds and its affiliates are not responsible for harm, loss, or injury arising from reliance on AI-generated data.

10.2 Exclusion of Certain Damages

• Any indirect, incidental, consequential, or punitive damages.
• Loss of data, health, reputation, profit, or revenue.
• Medical errors, side effects, or outcomes based on AI interpretations.
• Service interruptions, data loss, or downtime due to maintenance or third-party dependencies (such as Firebase, Vertex AI, or Google Cloud).

These exclusions apply even if Nebliu Digiminds has been advised of the possibility of such damages.

10.3 AI Inaccuracy Disclaimer

AI-based recognition models depend on lighting conditions, image quality, and data variability. Pill Pal’s outputs may occasionally contain misidentified medicines, inaccurate dosage data, or incomplete health information.

Users are advised to treat all AI results as supportive insights only, and not as absolute fact or medical instruction. Nebliu Digiminds assumes no liability for errors arising from image distortion, mislabeled data, or network interruptions.

10.4 Maximum Liability Cap

If, despite these disclaimers, any liability is established against Nebliu Digiminds, it shall be limited as follows:

• Maximum aggregate liability shall not exceed the total amount paid by the user (if any) for Pill Pal premium services within the preceding twelve (12) months before the claim arose.
• This limitation applies regardless of the cause of action — whether in contract, tort (including negligence), strict liability, or otherwise.

10.5 Third-Party Dependencies

The Pill Pal platform integrates APIs and services from third-party providers such as Google Firebase, Vertex AI, and Cloud Storage. Nebliu Digiminds is not responsible for technical failures, outages, or data inaccuracies arising from these third-party systems. Users acknowledge that continued use of the app depends on these integrations, which may occasionally be unavailable.

10.6 User Responsibility

Users are responsible for how they interpret and apply AI-generated insights. The app should not replace professional judgment, emergency care, or prescription guidance.

In case of adverse reactions or health issues, users must contact a licensed doctor immediately.

10.7 Legal Jurisdiction

This limitation of liability shall be interpreted in accordance with applicable law under the governing jurisdiction of India (or the user’s country, where local law applies). Some jurisdictions may not allow certain liability exclusions — in such cases, Nebliu Digiminds’ liability shall be limited to the minimum extent permitted by law.

• Your misuse of the Pill Pal platform, services, or AI-generated outputs;
• Your violation of these Terms of Service, applicable laws, or third-party rights;
• Your breach of intellectual property, privacy, or content ownership obligations; or
• Any act or omission resulting in legal disputes or claims brought by third parties.

11.1 Scope of Indemnity

The indemnification obligation applies to, but is not limited to, claims involving:

• Unauthorized or harmful use of AI-generated medical information;
• Distribution or modification of copyrighted or proprietary Pill Pal materials;
• Sharing of confidential or sensitive data without consent;
• Misrepresentation of AI outputs as verified medical advice;
• Defamation, data leaks, or digital harm caused through the platform.

This means if your actions (intentional or accidental) cause Nebliu Digiminds or its partners to face legal or reputational damage, you will bear the responsibility for defending and compensating those losses.

11.2 User Responsibility

You are solely responsible for:

• The accuracy of data (text or images) you upload for AI analysis.
• The interpretation and use of the AI-generated results.
• Compliance with all relevant laws, medical guidelines, and local regulations.

You must ensure that no content uploaded violates the rights of others, contains false or harmful information, or circumvents or exploits the AI system for illegal, unethical, or commercial misuse.

11.3 Company’s Rights

Nebliu Digiminds reserves the right to:

• Assume exclusive defense and control of any matter otherwise subject to indemnification;
• Request your full cooperation in defending such claims; and
• Recover all reasonable legal and administrative costs incurred in connection with your actions or misuse.

If required, you agree to participate in legal proceedings or provide necessary documentation supporting Nebliu Digiminds’ defense.

11.4 Third-Party Claims

If any third party (e.g., regulatory body, medical institution, or affected individual) files a claim against Nebliu Digiminds due to your actions or uploaded content, you agree to:

• Fully cooperate with our legal representatives;
• Bear the cost of settlements, judgments, or penalties; and
• Cover any damages resulting from such claims.

This protection also applies to claims arising from data misuse, unapproved redistribution, or false health-related communication.

11.5 Limitation

This indemnity does not require you to defend Nebliu Digiminds for issues solely caused by company negligence or misconduct, unauthorized data breaches beyond your control, or failures within third-party infrastructure (e.g., Google Cloud/Firebase). However, it does apply to any actions, uploads, or usage choices you directly make on the Pill Pal platform.

12.1 Third-Party Dependencies

Pill Pal relies on external systems that operate independently from Nebliu Digiminds. This includes:

• AI inference models hosted on Google Cloud or Vertex AI
• Data storage and authentication managed by Firebase and Google Identity
• Payment and billing systems provided through Google Play or App Store
• Analytics and usage metrics (non-personal data only)

Since these are managed by their respective providers, Nebliu Digiminds cannot guarantee uninterrupted service, response times, or feature stability if third-party systems experience disruptions, outages, or configuration changes.

12.2 No Control Over External Policies

Each third-party provider maintains its own privacy policy, security practices, and data retention protocols. By using Pill Pal, users acknowledge and agree to review and accept the following applicable policies:

• Vertex AI Terms of Service

Nebliu Digiminds does not have control over how these providers collect, process, or use your data. Any issues or disputes arising from these services must be resolved under their respective terms.

12.3 External Links and References

Pill Pal may display external references, such as:

• Verified medical sources for educational information
• Links to nearby pharmacies, hospitals, or public health organizations
• Regulatory or government medical databases

While these links are included for convenience, Nebliu Digiminds does not endorse or verify their accuracy, content, or policies. Users access external sites at their own risk, and Nebliu Digiminds is not liable for any damages, data breaches, or misinformation encountered on third-party platforms.

12.4 Data Transmission Through Third-Party Services

When users upload images, text, or language preferences, limited information may pass through secure third-party infrastructure. All transmissions are protected by TLS 1.3 encryption and processed only to fulfill user requests (e.g., medicine identification). No permanent storage occurs unless explicitly enabled via a Pill Pal feature (e.g., “Save to History”).

However, as third-party APIs evolve, Nebliu Digiminds cannot guarantee the absolute behavior or uptime of such services.

12.5 Disclaimer of Liability

• Service outages, latency, or feature limitations caused by third-party APIs
• Security vulnerabilities or data handling issues outside our direct control
• Inaccuracies or data corruption due to third-party processing errors
• Damages or losses resulting from the use of external links or integrations

Users are encouraged to review all linked terms and proceed with caution when accessing external content or sharing information with third-party systems.

12.6 User Responsibility

• Ensuring that your use of third-party tools complies with their respective terms
• Understanding that your data may be processed or stored temporarily by their systems
• Maintaining up-to-date app versions to ensure continued compatibility with API changes

If you disagree with any third-party policy, you must discontinue using the Pill Pal service that depends on that integration.

13.1 Grounds for Termination

Your account or access to Pill Pal may be suspended or permanently terminated for any of the following reasons:

• Breach of Terms: Failure to comply with any clause of the Terms of Service, Privacy Policy, or Acceptable Use Policy; misuse of AI-generated results, including attempts to treat or diagnose illnesses without professional consultation.
• Fraud or Misrepresentation: Providing false identity, inaccurate account details, impersonating others, or misusing payment methods.
• Illegal or Harmful Activity: Uploading copyrighted, harmful, or illegal content, or attempting to reverse-engineer or exploit Pill Pal’s AI system, database, or API.
• Security or Data Threats: Activities that compromise the security, performance, or stability of Pill Pal’s systems.
• Non-Payment or Subscription Violations: Failure to complete or renew premium payments, chargebacks, or payment disputes.

13.2 Termination by Nebliu Digiminds

Nebliu Digiminds may suspend or terminate access immediately if user actions threaten system security or violate law, or with prior notice for non-critical issues to allow corrective action. In some cases, access may be temporarily restricted while we investigate suspicious or disputed activity.

13.3 Termination by the User

You may terminate your Pill Pal account at any time by deleting your account through in-app settings or sending a termination request via email to support@nebliudigiminds.com.

Upon receiving your request, stored data and saved history will be permanently deleted after 30 days (unless legally required to retain it). Subscription users may lose remaining premium access unless a refund is eligible under the Payment Policy.

13.4 Effects of Termination

Once your account or license is terminated, all rights to use Pill Pal and its AI features immediately end. Ongoing scans, saved medicine history, or premium services will no longer be accessible. You must uninstall the application and discontinue use of any associated data or AI outputs. Nebliu Digiminds may retain limited anonymized data for compliance, analytics, or auditing purposes as permitted by law. Termination does not affect outstanding financial obligations or liabilities incurred before the termination date.

13.5 Data Deletion and Retention

Upon termination, most user data (images, search logs, preferences) will be deleted permanently from active databases within 30 days. Backup copies may persist temporarily in secure archives for up to 90 days, accessible only for legal, audit, or compliance purposes. If required by law (e.g., under GDPR or India’s DPDP Act), users can request proof of deletion via email.

13.6 Reinstatement

If your account was terminated for minor or unintentional violations, you may request reinstatement by contacting support@nebliudigiminds.com. Nebliu Digiminds reserves full discretion to accept or reject reinstatement based on the nature of the prior breach.

13.7 Legal Survival

Certain clauses — including Intellectual Property Rights, Limitation of Liability, Indemnification, and Dispute Resolution — will continue to apply even after termination of your account.

14.1 Governing Law

This Agreement shall be governed by and construed under the Information Technology Act, 2000 (India), the Digital Personal Data Protection Act (DPDP), 2023, and other applicable Indian laws and regulations related to digital platforms, consumer rights, and AI governance.

14.2 Jurisdiction

For enforcing or resolving disputes, the exclusive legal jurisdiction and venue shall lie with the courts of Bengaluru, Karnataka, India. You voluntarily waive any objection to venue or jurisdiction in such courts. Nebliu Digiminds may, at its discretion, pursue remedies in alternative venues if required for enforcement or intellectual property protection.

14.3 Dispute Resolution Mechanism

Both parties agree to the following structured process:

Negotiation

Either party shall notify the other in writing and make best efforts to resolve the issue through good-faith discussions within 30 days.

Arbitration

If negotiation fails, the matter shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), conducted in English in Bengaluru before a sole arbitrator appointed jointly by both parties. The arbitrator’s decision shall be final and binding.

Judicial Enforcement

Either party may approach a competent court in Bengaluru to enforce or challenge the arbitration award. Nebliu Digiminds reserves the right to seek injunctive or equitable relief from the courts directly.

14.4 International Users

If you access Pill Pal from outside India, you are responsible for ensuring compliance with local laws. By continuing to use the service, you acknowledge that Indian law governs your relationship with Nebliu Digiminds and any dispute will be subject to Indian legal jurisdiction.

14.5 Class Action Waiver

To the extent permitted by law, you agree not to participate in or file any class action, class arbitration, or representative claim against Nebliu Digiminds.

14.6 Time Limitation for Claims

Any claim arising out of or related to your use of Pill Pal must be filed within one (1) year from the date the cause of action arises.

14.7 Notices

All legal notices, communications, or arbitration requests shall be sent to:

15.1 Notification of Updates

When material changes are made, a revised version will be published with a new “Last Updated” date. Users may receive in-app or email notifications if changes significantly affect rights, privacy, or billing. Minor adjustments may occur without prior notice. Continued use after updates is deemed acceptance.

15.2 User Responsibility

It is your responsibility to regularly review the Terms and Privacy Policy. If you do not agree with modified terms, discontinue using Pill Pal and request account deletion via support@nebliudigiminds.com.

15.3 Substantive Policy Changes

If a change substantially affects user data, consent, or privacy, Nebliu Digiminds will issue notice at least 7 days before the change (where applicable), highlight new or modified sections, and provide an option to review and accept before continuing usage.

15.4 Legal Standing of Revisions

Each new version supersedes previous versions. Nebliu Digiminds may archive prior versions internally for compliance and auditing.
